Over time, just as some of the wiser founders had quietly hoped, these defects were corrected. Yet other significant flaws persist, and, in fact, some have grown over time. So vital is fairness to the American sense of identity that it must be a guiding light as we reconsider the Constitution. Unfairness breeds disrespect for the system itself, and as unfairness grows, it threatens citizens’willingness to follow and abide by the decisions rendered under the system. * The needs of the present and future, not the past.

It is true that we may be no more capable than the founders of peering into the future and perceiving the needs of the nation a century or two from now. But we are in a much better position to evaluate how well the American system has worked, after two-plus centuries’ experience, and then to adapt the structure to a vastly changed continental country. The founders were magnificent innovators, yet they had to rely mainly upon speculation and theory as they constructed a government for which there were no compelling precedents.

While the current Constitution includes a detailed plan for presidential succession, there is no such plan for the legislative branch. There ought to be; the frightening age in which we live demands it. S. Senate took up a Democratic-sponsored resolution disapproving of President George W. S. troops to that war-torn country. S. House of Representatives had earlier been able to secure a large (246 to 182) majority for the same resolution. At the end of the day, the Senate voted 56 to 34 to end debate and take up the resolution—the fifty-six senators comprising the majority that would have supported the resolution itself.
